Terms of Use

Yobi Group, LLC (“Yobi Group”, “we”, “us”, or “our”) operates Cue Skip. These Terms of Use govern your access to cueskip.com (the “Marketing Site”) and general use of the Cue Skip Click & Collect platform (the “Platform”). By accessing or using the Marketing Site, you agree to these Terms. If you do not agree, do not use the Marketing Site.
Restaurant tenants and their authorized users are also subject to the separate Cue Skip subscription or service agreement provided during onboarding. If there is a conflict between these Terms and a signed tenant agreement, the tenant agreement controls for that customer.
What Cue Skip provides
Cue Skip is a Click & Collect platform for catering kitchens. It includes tools such as branded storefronts, guided box and assortment ordering, cutoff and capacity controls, kitchen print workflows, order notifications, and payment integrations configured by each restaurant tenant.
Marketing Site use
You may use the Marketing Site only for lawful purposes. You agree not to:
- Use the Marketing Site in any way that violates applicable law
- Attempt to gain unauthorized access to our systems or data
- Interfere with the security, availability, or performance of the Marketing Site
- Submit false, misleading, or abusive information through our contact forms
- Scrape, copy, or republish Marketing Site content except as allowed by law
Restaurant storefronts and guest orders
When you place an order on a restaurant’s Cue Skip storefront, you are transacting with that restaurant. Menu items, pricing, pickup times, refunds, food safety, and customer service for the order are the restaurant’s responsibility. Cue Skip provides the ordering technology and related workflows on behalf of the restaurant. Payment processing may be handled by third-party payment providers connected by the restaurant.
Text messages (SMS)
When a restaurant enables guest SMS and you opt in at checkout by actively checking the consent box, we may send transactional text messages about your order on that restaurant’s behalf. These messages may include order confirmation, ready-for-pickup, complete or cancelled updates, and occasional staff-sent updates related to an existing order. Message frequency varies by order activity. We do not use guest SMS for marketing or promotional campaigns. Your phone number and SMS opt-in status are processed to deliver those messages and to honor opt-outs. Reply STOP to cancel guest SMS; reply HELP for help. Message and data rates may apply.
Text messaging originator opt-in data and consent will not be shared with any third parties, affiliates, or partners for marketing or promotional purposes.
Restaurant staff may also receive transactional kitchen/admin order-alert SMS by logging into the password-protected Cue Skip admin dashboard and actively checking an unchecked consent box when entering their own mobile number. Staff alerts are not marketing messages. Reply STOP to cancel; reply HELP for help.
Accounts and access
Access to tenant admin features requires an account provisioned by Cue Skip or an authorized restaurant administrator. You are responsible for safeguarding login credentials and for activity under your account. Notify us promptly if you believe your account has been compromised.
Intellectual property
The Marketing Site, Platform software, branding, documentation, and related content are owned by Yobi Group, LLC or its licensors and are protected by intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, sell, or create derivative works from our services or content without our prior written consent.
Third-party services
The Platform may integrate with third-party services such as payment processors, email providers, SMS carriers, and hosting providers. Your use of those services may be subject to their separate terms and privacy policies. We are not responsible for third-party services outside our reasonable control.
Disclaimers
THE MARKETING SITE AND PLATFORM ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE OPERATION.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOBI GROUP, LLC AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE MARKETING SITE OR PLATFORM. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE MARKETING SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100), EXCEPT WHERE SUCH LIMITATIONS ARE PROHIBITED BY LAW.
Indemnity
You agree to defend, indemnify, and hold harmless Yobi Group, LLC and its affiliates from claims, damages, losses, and expenses arising out of your misuse of the Marketing Site or violation of these Terms.
Suspension and termination
We may suspend or terminate access to the Marketing Site or Platform if we reasonably believe you have violated these Terms, created risk for us or other users, or where required by law. Provisions that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, and indemnity.
Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Marketing Site after changes become effective constitutes acceptance of the updated Terms.
Governing law
These Terms are governed by the laws of the United States and the state in which Yobi Group, LLC is organized, without regard to conflict-of-law rules. Any dispute arising from these Terms or the Marketing Site will be brought in the courts located in that state, unless applicable law requires otherwise.
